These Terms of Service (“Terms”) govern your use of the website capcitygreens.com and any purchases made through it. The site is operated by Capital City Gardens LLC, doing business as Cap City Greens (“Cap City Greens,” “we,” “us,” or “our”), located at 6200 Avery Rd, Suite B, Dublin, OH 43016. By accessing this site or placing an order, you agree to these Terms.

Products

We grow and sell fresh microgreens and related farm products. Because our products are fresh, perishable, and grown to order, availability varies by season and harvest schedule. Product descriptions, weights, and images are provided in good faith; natural variation in size, color, and appearance is normal for fresh produce.

Orders and Payment

When you place an order, you agree to provide accurate and complete information. An order is an offer to purchase; we may accept or decline any order, and we will notify you if we cannot fulfill it. Prices are listed in U.S. dollars and may change without notice before an order is placed. Payment is due at the time of purchase unless we have agreed to invoice terms in writing.

Delivery and Pickup

We deliver within our local service area around Columbus, Ohio, and offer pickup by arrangement. Delivery dates and times are estimates based on our harvest and delivery schedule. Please inspect your order on arrival and refrigerate fresh products promptly.

Freshness Guarantee and Refunds

We stand behind the freshness of what we grow. If a product arrives damaged or below our quality standard, contact us within 24 hours of delivery at [email protected] or (419) 215-9864 and we will replace it or refund that item. Because our products are perishable food items, we cannot accept returns of delivered product.

Wholesale Accounts

Terms for restaurant, distributor, and other wholesale customers may be set out in a separate written agreement. If there is a conflict between that agreement and these Terms, the written agreement controls for that customer.

Acceptable Use

You agree not to misuse this site, interfere with its operation, or use it for any unlawful purpose.

Intellectual Property

The Cap City Greens name, logo, and site content belong to Capital City Gardens LLC and may not be used without our written permission.

Limitation of Liability

To the extent permitted by law, our liability arising from any purchase is limited to the amount paid for the product giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under Ohio law.

Governing Law

These Terms are governed by the laws of the State of Ohio. Any dispute relating to these Terms or a purchase will be handled in the state or federal courts located in Franklin County, Ohio.

Changes to These Terms

We may update these Terms from time to time. The version posted on this page at the time of your order applies to that order.
